These Terms & Conditions ("Terms") govern your access to and use of the PoolChecker website, mobile application, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on the Service for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose or for any public display
• Attempt to decompile or reverse engineer any software contained on the Service
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or "mirror" the materials on any other server
• Use automated tools to scrape or collect data from the Service

2. Disclaimer

The materials on the Service are provided on an 'as is' basis. PoolChecker makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, PoolChecker does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on the Service or otherwise relating to such materials or on any sites linked to the Service.

3. Limitations

In no event shall PoolChecker or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the Service, even if PoolChecker or an authorized representative has been notified orally or in writing of the possibility of such damage.

4. Accuracy of Materials

The materials appearing on the Service could include technical, typographical, or photographic errors. PoolChecker does not warrant that any of the materials on the Service are accurate, complete, or current. PoolChecker may make changes to the materials contained on the Service at any time without notice.

5. Links

PoolChecker has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by PoolChecker of the site. Use of any such linked website is at the user's own risk.

6. Modifications

PoolChecker may revise these terms of service for the Service at any time without notice. By using the Service, you are agreeing to be bound by the then current version of these terms of service.

7. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the United States, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.

8. Professional Network Agreement

For professionals joining the PoolChecker network:

• You represent that you are a legitimate, established pool service professional.
• You agree not to use the network for unlawful purposes or to harass homeowners.
• Lead purchases are non-refundable once the customer information has been provided.
• You must comply with all applicable laws when contacting leads and performing services.
• PoolChecker reserves the right to remove professionals from the network for violations of these terms.

Account deletion

Team-member accounts (technicians and managers) on PoolChecker Pro may be deleted at any time from My Account → Delete Account. Deleting an account permanently ends the sign-in and removes the account holder's personal details; operational records of work performed (service visits, timesheets, and similar) are business records of the employing company and are retained by that company in anonymized form. Accounts that own a company must first transfer ownership or delete the company's data before the account can be deleted. Details are described in our Privacy Policy.

9. No Medical Advice

PoolChecker provides general pool maintenance and chemistry information for educational purposes only. We are not healthcare professionals. Information provided in the Service should not be construed as medical or professional advice. Always consult with qualified pool professionals for specific guidance on your pool.

10. User Conduct

You agree not to:

• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service
• Upload or transmit viruses or any other malicious code
• Harass, abuse, or harm another person
• Submit content that is false, misleading, or deceptive
• Violate any applicable laws or regulations
